Terms of Service
These Terms of Service (“Terms”) govern your use of AgentPrinter, including the API, the website at agentprinter.app, and the SMS channel (together, the “Service”). The Service is operated by SBD Co (“SBD Co,” “we,” “us”). By creating a job, paying for one, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for an organization, you agree on its behalf and confirm that you have authority to do so.
1. The Service
AgentPrinter lets you, or software acting for you, submit a document and a U.S. mailing address, pay per piece, and have the document printed and mailed as a letter or postcard. We use third-party providers for address verification, printing, and mailing (Lob), payments (Stripe), and SMS (Telnyx).
You must be at least 18, or the age of majority where you live, to use the Service.
2. Automated agents
You may use AI agents, scripts, or other automated tools to use the Service. You are responsible for every job created, paid for, revised, or cancelled by an agent or tool acting on your behalf, as if you had done it yourself. You are also responsible for reviewing the preview before you pay.
3. Your content and recipients
You keep ownership of the documents you submit. You grant SBD Co and its providers a limited license to host, process, render, print, and mail your content, only as needed to provide the Service.
You are solely responsible for your content and your choice of recipients. You represent that:
- you have all the rights and permissions needed to send the content to the recipient;
- your content and mailing comply with all applicable laws and USPS regulations; and
- you have a lawful basis to use each recipient’s name and address.
4. Acceptable use
You may not use the Service to send, or attempt to send, mail that:
- is illegal, fraudulent, deceptive, or intended to mislead, including impersonating a person, business, or government agency, or imitating official, legal, or financial notices;
- threatens, harasses, stalks, intimidates, or defames anyone, or goes to a person who has asked you not to contact them or whom a court order bars you from contacting;
- contains hate speech, sexually explicit material involving minors, or content that promotes violence;
- infringes intellectual property, privacy, or publicity rights;
- is unsolicited bulk advertising sent in violation of law; or
- violates USPS rules, including those on mailability and prohibited content.
You also may not attempt to bypass rate limits or security controls, probe or attack the Service or our providers, or use the Service to access internal or private network resources (for example, through pdf_url).
We may refuse, hold, or cancel any job, and suspend access, if we believe it violates these Terms or creates risk for us, our providers, or others. We may also report unlawful activity to the authorities.
5. Pricing, payment, and refunds
- Pay per send. The price is shown when the job is created and is charged through Stripe Checkout. There are no accounts or subscriptions. Prices may change, but a change never affects a job that has already been created.
- Payment window. Unpaid jobs expire after the payment window, currently about 4 hours. The document for an expired job is deleted. If a payment completes but reaches us only after the job has expired, we refund it automatically.
- Cancellation. You may cancel a job within 30 minutes of creating it, as long as it has not been submitted for printing. If you had already paid, you receive a full refund.
- Failed fulfillment. If we or our providers cannot print and mail a paid job, contact us and we will refund the price of that job.
- No other refunds. Once a job has been submitted for printing, it cannot be cancelled or refunded. This includes jobs that the carrier returns or cannot deliver, and jobs that contain errors you approved in the preview.
6. Delivery
Delivery estimates come from our providers and the U.S. Postal Service. We do not guarantee them. We are not responsible for delays, loss, damage, or misdelivery once a mailpiece is handed to the carrier, or for addresses you supplied that were correct as verified but were wrong for your intended recipient.
7. SMS program terms
AgentPrinter SMS lets you create postcards and receive status updates for jobs you create by text message.
- Opting in: text START to the AgentPrinter number. You will receive messages that reply to your commands, plus status updates (such as paid, mailed, or expired) for postcards you created by text.
- Frequency: message frequency varies with your activity.
- Costs: message and data rates may apply. Postcards you create are charged separately through Stripe Checkout, as described in Section 5.
- Opting out: reply STOP (or UNSUBSCRIBE, QUIT, END, or CANCEL) at any time. We will confirm your opt-out and send no further messages unless you opt in again with START.
- Help: reply HELP, or email legal@sbdco.biz.
- Carriers are not liable for delayed or undelivered messages.
- Your mobile information is handled as described in our Privacy Policy and is never shared with third parties for marketing.
8. Intellectual property
The Service, including its software, design, and branding, belongs to SBD Co and its licensors. Postcards may carry a small “sent via agentprinter.app” mark. Apart from the limited right to use the Service under these Terms, you receive no rights in it.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that address verification will be accurate in every case.
10. Limitation of liability
To the maximum extent permitted by law, SBD Co and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid for the job giving rise to the claim or $50.
11. Indemnification
You will defend, indemnify, and hold harmless SBD Co and its providers from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your mailings, your use of the Service (including through automated agents), or your violation of these Terms or the law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Nevada, and you consent to their jurisdiction. Either party may, however, bring an individual claim in small-claims court where it qualifies.
13. Changes and termination
We may modify, suspend, or discontinue the Service at any time. We may update these Terms by posting a new version here with a new effective date. Your continued use of the Service after an update means you accept the new Terms, but a change never affects a job that has already been created. Sections 3, 5, and 8 through 12 survive termination.
14. General
These Terms and our Privacy Policy are the entire agreement between you and SBD Co about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
